The IP address is only analysed in the event of an attack on the network infrastructure of www.bindella.ch and for statistical purposes and may be used during the course of criminal proceedings for the purpose of identification and taking civil and criminal action against the user in question.
This constitutes our legitimate interest in the data processing within the meaning of Art. 6 (1) f of the European Union’s General Data Protection Regulation (GDPR).
Personal data for the creation of your customer account on our website are entered voluntarily. Entering truthful information is mandatory in the case of certain personal data. This applies to the following:
- Gender
- First name
- Last name
- Address
- Email address
- Password
Any further data are provided voluntarily. We need the mentioned data for the processing and administration of our website, for checking the entered data for plausibility, i.e., for the establishment, content design, processing and modification of the contractual relationships concluded with you via your user account. The e-mail address and the password together form the login data. The data in the customer account can be viewed and modified by the customer at any time.
The legal basis for processing the data for this purpose consists in the consent given by you, our overwhelming legitimate interest, and the performance of a contract pursuant to Art. 6 (1) a, b and f of the GDPR.
During the use of the website by logged-in registered customers, we collect data for statistical reasons and to enable the proper functionality of the portal. The following data, in particular, are collected:

If you wish to purchase a product on our website, we require various data in order to execute the purchase agreement. Entering the following data is mandatory:

If you are registered and have a customer account, we will store your data in the customer account for the next purchase.
As part of our online application process, we collect the information required for an application process at Bindella. The following applicant data are therefore collected and processed:

- Email address
- Date of birth
- The documents and references submitted by the applicant
Any further information is provided voluntarily.
By registering your application, you agree to be contacted and informed as part of the application process.
You can modify or delete your application at any time and request that we assist you with this by contacting our Employee HR department (mitarbeitende@bindella). Of course, you can also withdraw your application at any time.
The legal basis for the data processing consequently consists in steps taken prior to entering into a contract and in our legitimate interest pursuant to Art. 6 (1) b and f of the GDPR. The legal basis for other data processing consists in the consent you have given pursuant to Art. 6 (1) a of the GDPR.
By registering at www.bindella.ch and/or by making a purchase in the Bindella online shop, you consent to our processing of your personal data for advertising measures, such as the sending of emails with general information or emails of a promotional nature (newsletter) or the delivery of customer-specific advertising.
You will only receive a newsletter from us if explicitly requested. When you register for the newsletter, your email address will be used together with your consent for our own advertising purposes until you unsubscribe from the newsletter. You can unsubscribe at any time. We have the right to commission third parties with the technical execution of advertising measures and have the right to share your data for this purpose (see Section 2 below).
Your consent constitutes our legal basis, within the meaning of Art. 6 (1) a of the GDPR, for processing your email address.
We only share your personal data when you have explicitly consented to this, when there is a legal obligation to do so, or when this is necessary for enforcing our rights, particularly for enforcing claims arising from the contractual relationship. We also share your data with third parties to the extent that this is necessary for the execution of a contract. For this purpose, we pass on the necessary data to subsidiaries, transport companies, banks and other service providers. These service providers use your data exclusively for order processing only and not for any other purposes.
Our webhosting provider, Adobe Magento Cloud, USA, is one service provider with whom the personal data collected via the website are shared or who has or may have access to them. The website is hosted on servers in Switzerland. The data are shared for the purpose of providing and maintaining the functionalities of our website. This constitutes our legitimate interest within the meaning of Art. 6 (1) f of the GDPR.
Finally, when payment is made by credit card on the website, we forward your credit-card information to your credit-card provider and to the acquiring bank. Each time you choose to pay by credit card, you will be asked to enter all mandatory information. The legal basis for sharing the data consists in the performance of a contract pursuant to Art. 6 (1) b of the GDPR. Regarding the processing of your credit card information by these third parties, please also read the terms and conditions as well as the privacy policy of your credit card issuer.
For reservations at a Bindella restaurant, our website uses the reservation service Localina (www.local.ch) provided by local.ch AG, c/o Swisscom (Schweiz [Switzerland]) AG, Genfergasse 14, 3050 Bern Swisscom. When you use our reservation service, you send local.ch data like your name, telephone number, email address, the desired number of guests, or comments via the text boxes. These data are necessary for executing an online reservation and must therefore be stored at local.ch AG. According to local.ch AG, your data will generally not be shared with third parties, with the exception of your selected restaurants, and they will only be shared when there is a legal obligation to do so or in order to enforce the contractually agreed terms of use or the contractual claims of local.ch AG. The legal basis for processing the data for these purposes consists in our legitimate interest pursuant to Art. 6 (1) f of the GDPR and the performance of a contract and the taking of steps prior to entering into a contract pursuant to Art. 6 (1) a of the GDPR.
We store the data mentioned in the sections above in a central electronic data processing system. The data concerning you are systematically collected and combined in the process for the purpose of processing your orders and executing the contractual services. We use software from Sage Schweiz AG, Platz 10, 6039 Root D4, Switzerland, for this. The processing of these data in the context of the software is based on our legitimate interest, within the meaning of Art. 6 (1) f of the GDPR, in managing customer data in a customer-friendly and efficient manner.
We store personal data only for as long as is necessary in order to perform the processing within the scope of our legitimate interest. We retain contract data for longer as this is required by statutory retention obligations. Retention obligations that oblige us to retain data result from accounting and tax law. According to these regulations, business communication, completed contracts, and accounting documents must be retained for up to ten years. If we no longer need these data in order to perform services for you, the data will be locked. This means that the data can then only be used for accounting and tax purposes.
If we provide services in advance, such as in the case of purchases on account, we may obtain credit information based on mathematical statistical procedures from a credit agency in order to safeguard our legitimate interests. To this end, we will transmit the personal data needed for a credit check to a credit agency and use the information received about the statistical probability of a default on payment to reach a carefully considered decision on the establishment, implementation, or termination of a contractual relationship. The credit information may contain probability data (credit scores), which are calculated on the basis of scientifically accepted mathematical statistical procedures and using address data, among other things. Your legitimate interests are taken into account in accordance with legal regulations.

We are also entitled to transfer your personal data to third companies outside Switzerland, in particular subsidiaries, insofar as this is necessary for the processing of the contract. These enterprises are obligated to provide the same extent of data protection as the vendor. If the level of data protection in a country does not meet the Swiss or European standard, we will contractually ensure that the protection of your personal data is at all times equal to that in Switzerland or the EU.
For the sake of completeness, we would like to point out for users who are resident or domiciled in Switzerland that there are supervision measures in place in the USA by US authorities which generally allow the storage of all personal data of all persons whose data has been transferred from Switzerland to the USA. This happens without differentiation, limitation, or exception based on the objective being pursued and without an objective criterium that makes it possible to restrict the US authorities’ access to the data and their later use to very specific, strictly limited purposes that might justify the encroachment associated with both the access to these data and their use. Please also be advised that data subjects from Switzerland do not have any available legal remedies in the USA that would allow them to gain access to the data concerning them and to have them rectified or erased and that there is no effective judicial protection against general access rights of US authorities. For users residing in a member state of the EU, we would like to point out that the USA does not have a sufficient level of data protection from the perspective of the European Union - among other things due to the issues mentioned in this section. Insofar as this Privacy Policy explains that recipients of data (such as Google) have their place of business in the USA, we will ensure, either by means contractual regulations for these enterprises or by ensuring that these enterprises are certified under the EU–U.S. or Swiss–U.S. Privacy Shield, that your data are appropriately protected by our partners.
You can request information about the personal data we have stored about you at any time or view and change these data by logging in on our website with your login data. A formal request for information must be made in writing and include proof of identity.

Please be advised that, in the event that your data are erased, you will not be able to use our services or at least not to the full extent.
You also have the right to request that we send you the data that you have provided to us (right to data portability). Upon request, we will also forward the data to a third party. You have the right to receive the data in a commonly used file format.
You can revoke your consent to certain data processing at any time with effect for the future.
Please note that certain data are subject to statutory retention periods. These data must be stored by us until the retention period has elapsed. We lock these files in our system and use them only for fulfilling our legal obligations.
We use appropriate technical and organisational security measures to protect your personal data stored with us against tampering, partial or complete loss and against unauthorised access by third parties. Our security measures are continuously improved in keeping with technological developments.
If you register as a customer with us, you must enter your personal password each time in order to access your customer account. Before the data are transmitted to the provider, the IP address is truncated within the Members States of the European Union or in another state that is party to the Agreement on the European Economic Area by activating the IP anonymisation («anonymizeIP») on our website. Moreover, during the transmission, the IP address will not under any circumstances be linked with other data concerning the user. According to Google Inc., the IP addresses are anonymised so that identification is not possible (IP masking). Google is also listed as a Privacy Shield participant. The Privacy Shield agreement between the EU and the USA guarantees minimum standards of data protection.
We also use Google Remarketing (DoubleClick by Google) for online advertising and in order to evaluate the use of our website. The combined use of first-party cookies and third-party cookies makes it possible to compile reports evaluating how ad impressions are related to website visits. Third-party vendors, including Google, have the ability to serve ads on websites and to target and optimise them based on demographic characteristics and interests (for example, age, gender or interests) based on previous visits to the website. Our website uses the online advertising programme «Google AdWords» and conversion tracking (Floodlight Conversion Tracking System) as part of this. Google conversion tracking is also a service provided by Google. When you click on an ad placed by Google, a cookie for conversion tracking is placed on your computer. These cookies are valid for a limited time. When you visit specific pages of our website and the cookie has not expired yet, we and Google can see that you clicked on the ad and were forwarded to this page. Every Google AdWords customer receives a different cookie. Thus, there is no way for cookies to be tracked via the websites of AdWords customers.
The information obtained with the help of the conversion cookie is used for the purpose of compiling conversion statistics. This tells us the total number of users who clicked on one of our ads and were redirected to a page tagged with a conversion tracking tag.
